Although his classmates visited him at the hospital every day, they brought him a review of the day.
They also planned to go to the same high school together.
But Chen Jae-han knew that he might have to go a completely different way.

He felt numb, his legs were numb, and he signed the judgement with the help of the bailiff and had his handprint.
Chen’s dream of life was destroyed by the aggressor.
It’s settled.
Following the first instance judgement, many informed persons, including members of Chen Jinghan ‘ s family, protested the verdict.
Fifty-five students of Chen Ji-han submitted to the court a letter of request for a lighter sentence.

In their letter, the students said: “They are true and do not favour Chen Guanghan because they are classmates. I’m sorry.
The Court has repeatedly been petitioned in good faith for a lighter sentence.
The petition was submitted to the court together with the Chen Jia ‘ s report of his serious injuries.
At the same time, the husband and wife had found a good lawyer to defend their son.

However, the court did not respond and even the second hearing was delayed.
The protests by the students and parents followed the silence and sunk the sea.
Because of the delay in the court ‘ s action, Chen ‘ s family had to go to Li Xiaodong ‘ s parents again and again.
They hoped that Li Xiaodong’s parents would lift their hands and deliver a letter of understanding.
However, Father Li did not feel his child was wrong, and he kept holding on to the death of Li Xiaodong.
Chan’s parents are angry and helpless.
However, Chen’s mother, Lee Yong-hye, remained reluctant to give up, and she went to the court door every day to wait for the judge in charge of the case in the absence of a response.

In the end, the judgement was upheld in second instance by the Intermediate People ‘ s Court of Zunnan County, Guizhou Province.
As a result, Chen was sent to Guizhou Juvenile Prison to serve his sentence.
When he was in prison, he was only 13 days away from the expected mid-level exam.
Shortly afterwards, Chen Jianhan’s parents filed a civil suit against Jin Wai, whose family was sentenced to $87,000.
At the same time, Li Xiaodong ‘ s parents have also brought civil proceedings against the Chen Zhang-han and He Shang families.
They believe that their son was stabbed to death by Chen Qianhan, or the knife of He Shangshan, and that it was too cheap for them to leave their families alone.
In a court of civil procedure, Lee Ying Hui defended his son himself.
She hoped that all of you would understand the mood of a mother and the helplessness of Chen’s response.
Most of them expressed sympathy.
But Li Xiaodong’s father said, “My family died anyway.” I’m sorry.
Finally, the Chen Jinghan family was sentenced to 152,000 and He Xhang to 87,000.
The perpetrators had died, the victims had been imprisoned and their families had to pay compensation, and the winner of the school violence was the perpetrator.
And Chen Jae-han, who is in prison, keeps saying to his parents, “Don’t get into trouble with his schoolmaster.”
Parents also listened to their sons.
Their failure to hold schools accountable does not mean that they do not hate them.
Mother and father Chen were confused, and his son was beaten twice in school on April 30th.
The first time in the cafeteria, the teacher didn’t know.
The second time, however, was near the entrance to the classroom, which lasted almost 30 minutes, during which no teacher was present.
They also sought justice from the headmaster and the head of the education department, but both sides avoided interviewing.
After that, they learned from their students that Li Xiaodong and Jin Wai had a record of fighting outside the school.
However, the school still has a “good school” certificate.
Without this certification, it would never have been possible for the two persons to remain in the Four.
They don’t understand why these two kids have to prove that they’re bullying students at school.
All of this has led both spouses to refuse their lives and to turn over their sons.
But the real problem that needs to be resolved now is that civil fines have not been paid.
A civil action fine of $110,000 was paid first by the Chen Jinghan family.
Of that, 60,000 were government compensation and another 50,000 were borrowed from relatives.
And the fact that the last 40 thousand or so left behind is no matter what happens, makes the two middle-aged very weak.
In 2017, they were suddenly notified of the failure to pay the remaining money: “If the rest of the money is not paid, Chen Qianhe will not be reduced. I’m sorry.
When they heard that, they came to 40,000 after paying their savings and borrowing money.
When the money was handed over to the court, the two families met again.
At this point, Li Xiaodong’s father was still in the shape of the district, and he spoke all kinds of bad words and obscenities to Chen’s parents.
Even worse, Li Xiaodong’s father also received numerous media interviews.
In his interviews, he continued to say that he was going to take revenge on Chen and even took his responsibilities clean.
He thinks the teachers didn’t teach Li Xiaodong well.
He had always stressed that Li Xiaodong had been a good boy since he was a child, and had been sent to Zion to get him to a better school.
As a result of their long work, Li Xiaodong was given full responsibility for his education.
He got bad because teachers didn’t do their education.
On the one hand, Chen Qianhan, who is not held accountable for the teacher, and on the other hand, the teacher is responsible for educating the father of the perpetrator.

It is no wonder that such an educational approach would produce perpetrators such as Li Xiaodong.

After Chen was serving his sentence, the Chen family did not abandon the case.
However, since the son’s affairs were too hard hit, Chen’s spirit and body had almost collapsed.
Lee Young-hye, watching him get worse every day, let him concentrate on making money and take charge of the case for his son.
At that time, Li Yung-hye ran through almost all the local law firms.
No one is willing to take over the case.
In 2018, the disappointed Lee Yong-hye decided to find a better lawyer.
On the Internet, she met Lin Lihong, a Beijing lawyer.
In response, lawyer Lin Lihong said, “This case reflects the most tragic outcome of the violence in the school, and I am trying to bring justice to all similar children. I’m sorry.
Soon, she started to turn over the case for Chen Jianhe.
Subsequently, she also discovered irregularities in the course of her trial that year.
For example, several of the children ‘ s transcripts were not identical, there was no audio-visual recording by the court and the signature of the court transcript was irregular.
That is to say, there are many irregularities in this case.
Outside the walls, Li Ying Hui, Chen Sun-Quan and lawyer Lin Lihong spared no effort in overcoming the case of a juvenile.
Within the walls, Chen didn’t give up because he was imprisoned.
Life in prison is very different from that in school, and Chen Ji-han stayed up all night on the first night of prison.
After so many waves, he thought that he would never be able to turn back in his life.
Fortunately, however, he met a juvenile police officer, Chen.
Officer Chen used to talk to Chen Jinghan and said, “If you want, the term of imprisonment can also be a term!” I’m sorry.
Officer Chan changed him.
Because of him, Chen Ji-han found a way back to life, he learned skills, read, played guitars and so on in prison.

He also decided to become a lawyer upon release.
In addition to Inspector Chen, the encouragement of his classmates has also been an impetus for him to move forward.
During his prison days, his former classmates also continued to send him letters to share his life outside the walls.

He thought back about the scene of the barbecue with his friends on January 20th, 2014.

I thought I was going to the same high school with my friends.
That was his happiest time.
Chen Jae-han smiles when he thinks about it.
But every time he comes out of his memories, he gets more emotional.
Chen Qianhan said with clarity, “I am in contact with them, and we will only go further.” I’m sorry.
This awakening looks really cool.
But he’s an unfaithful man.
Even in this situation, he has not stopped studying.
In January 2019, Chen Jae-han received a post-secondary diploma in criminal law in prison.
In March 2019, Chen Jianhan ‘ s parents filed their petition with the Supreme People ‘ s Court, which received the material.
On August 25, 2020, Chen was released on parole for good behavior.

He left Guizhou, where he had lost his youth, to train at a law firm in Beijing.
When he thought he could finally find one side of the world here, reality struck him hard.
As a result, there is a rule in the legal profession that “the profession must not be disciplined”.
In other words, it is impossible for Chen to become a lawyer as a person who has been in prison unless the case can be turned over.
But it’s not that easy to turn over.
Moreover, the case of self-defence is exceptional, and the Court ‘ s judgement is mostly based on the testimony of both parties involved.
As a result, courts tend to be more cautious in dealing with such cases and do not easily qualify as “self-defence”.
There’s nothing Chen can do.
A little thought.
Since the incident, many people have been horrified by Chen, and why is it that Chen is finally punished by law?
First, we want to confirm whether this is a school violence or a school bullying incident.
The Ministry of Education, in its April 2016 document, defined the difference between “school violence” and “school bullying”.
The fundamental difference between the two is:
1. Whether or not to include acts of violence committed by outsiders against their students ‘ personal property or school property.
In particular, “school violence” is covered and “school bullying” is not covered.
2. Whether or not it is repetitive and persistent, in which “school bullying” exists, while “school violence” is not always the case.
2. Who is the target, “school bullying” only includes students (underages), and “school violence” includes teachers and students.
The case is clearly one of “school violence”.
Looking back at the whole incident, it will be discovered that Li Xiaodong and his gang were responsible for the incident.
Chen is a victim.
But in the end, Chen Chang-han became a “killer” to protect himself.
How did they step into the black hole of fate? What role are those adults playing in it?
I. The beginning of the fate of two children
1. Forced independence
First of all, Li Xiaodong and Chen Jae-han are children who have come to school from their homes.
But why did they end up on two different paths, even affecting each other’s fate?
The greatest reason for this may be the educational environment.
Chen Jae-han is away from his parents, but he lives with the family of the second uncle.
And the students around him are mostly excellent students.
So he lives in a good environment of being cared for and loved.
Moreover, as can be seen from the article, Chen’s parents are teaching their sons “love and care”.
Because of the circumstances in which he is living, the people he knows are warm and pure, with little knowledge of violence.
But after all, Chen is away from his parents, from home, and inevitably to learn what independence is.
In the field, what he can really rely on is himself, and the only consolation he can give his parents is to read.
Thus, children like him would certainly not yield to violence, much less to the adults who depended on their families.
The only thing he can do is find a cousin of similar age.
And Li Xiaodong, he was alone in Zouan and never talked to his parents.
From an interview with the father, it was known that the father had given Li Xiaodong a “scolding” type of education, sometimes breaking a stick.
LEE Xiaodong, who grew up in this environment, began to go astray after being removed from parental control.

So how did Li Xiaodong get “bad”?
One of the reasons is probably because of the friends he knew — Lung and Kim Wai.
Under the guidance of these two men, Li Xiaodong’s deep-seated “insolence” was inspired.
He misappropriated his father’s “go-and-go-go” attitude and thought it was the only way to get “respect” from others.
If the other party disrespects himself, fight until the other party loses.
And all this, his parents are completely unaware.
Who’s his friend, what he’s done, knows nothing.
LEE Xiaodong went back on this road for lack of communication.
That is why Li Xiaodong, who was involved in the incident, committed repeated acts of violence against Chen Jae-han.
And Chen Jianhan’s conscious independence let him know that he cannot lose.
There’s a ring around this, and two people will never get out.
School tolerance and neglect
One of the places where Li Xiaodong committed violence against Chen Zhenghan was in school and in the toilet.
Even Li Xiaodong approached a group of people who came directly to Chen’s classroom to abuse him.
You really don’t know anything about this?
Moreover, Chen Xiaodong is not the only one who was raped by Li Xiaodong.
He and Kim Wai had been punished in school for their violence.
However, the school then issued two certificates of proof of good performance at school.
Why is that?
It is probably because of the connivance of schools and the indifference of parents that Li Xiaodong has become even more aggressive.
He felt that, whatever he did, the school would not deal with him and that the people around him would respect him.
Why not?
Thus, Chen Jianhan’s insubordination led him to go crazy, even with a knife drawn by Jin Wai and Yongsang.
As a result, he was shot and killed.
In the end, Li Xiaodong died and Chen was imprisoned.
The lives of the two children were thus subverted.
But there is another very important reason that ultimately led to such a tragedy.
This happened in 2014.
At that time, the concepts of “school violence” and “school bullying” were not very clear.
As a result, cases of “school violence” to death are largely included in the category of “accidents”.
What’s an accident-type case?
The word “accident” means “accident” and so forth, which means that the person concerned is not willing or willing because of the incident.
In legal terms, it is similar to traffic accidents, production accidents, medical accidents, etc.
It is for this reason that the incident at that time in Chen Qianhe was classified as an “accident”.
Thus, the case is dealt with under the category of “accident” laws.
Moreover, it is an indisputable fact that Chen Jianhan killed Li Xiaodong.
It was not until 2016 that a general distinction was made between “school violence” and “school bullying”, as listed at the beginning.
Thus, under legal conditions that were so imperfect at the time, Chen Jianhe was only sentenced to imprisonment.
In addition to the imperfections of the law, the case process at that time was not a special norm.
The evidence is still in a vaguely defined state and the accuracy of the evidence cannot be determined.
Various factors led to the tragic outcome of Chen Guanghan.
The Supreme Court of Justice of our country, after the completion of cases in the first instance of the National Criminal Law for 2015-2017, found that:
Fifty-five per cent of cases of violence in schools involved intentional injuries, and 11.59 per cent even resulted in the death of the victim.

By contrast, robbery, extortion, extortion, forced prostitution, rape, etc., in order to satisfy personal desires, account for 18.08 per cent.
Of the school violence involving intentional homicide, 70 per cent, or 67.44 per cent, is due to triviality.

In addition to this, the main point of contention in the Chen Shui case is whether Chen Xian Hen has the will to cause subjective harm.
That is to say, it should constitute a legitimate defence if Chen Qianhan’s knife was used to injure people simply to defend his own security, without the deliberate intent of subjectively harming them, but rather with passive involvement in the fight, followed by accidental injury only to deter the continuing unlawful aggression.
For his part, Lin Lihong, a lawyer at the Beijing City Attorney ‘ s Office, stated publicly that Chen Zheng ‘ s case was a classic self-defence and should not be held criminally responsible.
In our judicial practice, “self-defence” is premised on the existence of an ongoing unlawful violation, which can only be directed against the individual and, generally speaking, requires that the suppression of the unlawful violation must not clearly exceed the necessary limits, which may constitute an excessive defence.
In the event of a fight, the apparent similarity between the fight and the defensive act usually requires an examination of the subjective intent and nature of the act of the perpetrator in order to determine with precision whether the act constitutes self-defence or intentional injury.
In other words, the judge ruled that Chen Zheng’s actions were mainly related to his second “death” knife, which stabbed Li Xiaodong.
However, since the crime scene was not monitored and witnesses were unable to prove it, it was not possible to determine whether Chen was unintentional or intentional.
In December 2018, Chen Jianhan ‘ s family filed a petition with the Guizhou Provincial High Court to reopen the case.
The High Court dismissed the complaint, considering that the original decision was clear, that the applicable law was correct and that the sentence was appropriate.
In March 2019, Chen Jianhan ‘ s family filed a petition with the Supreme People ‘ s Court requesting that the case be reopened.
The Supreme People ‘ s Court currently receives relevant material.
On 3 September 2020, two seniors issued Guidance on the Legal Application of the Self-Defence Regime.
The Chief of the Research Unit of the Supreme People ‘ s Court, Kang Kaibo, has made it clear that there have been cases in the past in which the system of self-defence has been applied, that there have been problems of overstretched or even serious malfeasance, and that the guidance specifies the specific cases of self-defence, excessive defence and special defence.
With reference to violence in schools, the first response was to support victims in their resistance.
Sometimes, however, resistance costs a great deal.
Chen Jung-han fought bravely in his own way, but the outcome was devastating.
So, how exactly should violence in schools be stopped?
How can a victim of bullying resist? How can you protect yourself from resistance?
These are issues that require urgent reflection and refinement.
It is hoped that the tragedies of Chen and Li Xiaodong will not take place again.
