In 1984, a nine-year-old boy in Japan disappeared for no reason, and the last person to see him moved home after the incident. Fourteen years later, the murderer finally surfaced and was acquitted…
14 January 1984, Sapporo Fonping District, Japan.
Just after the New Year ‘ s anniversary, the residents ‘ peaceful lives were disrupted by a series of loud sirens.
Several police vehicles were parked near the apartment at the Second House, and the police were taking the snow to house-to-house investigations and visits.
Three days ago, 9-year-old Shimamaru Sud disappeared suddenly. (hereinafter referred to as Yuemaru)
This apartment was the last place he appeared, so the entire population was targeted.
By chance, the police had a very useful lead as soon as they reached the second level.
“On the day that the child was lost, I saw the woman and Junmaru say something. I’m sorry.
When witnesses said that, they raised their chins at the end of the corridor and had complex eyes.
The inner end of the corridor is room 201.
The head of the household is Shinko Kudo, a 29-year-old single mother living with a 2-year-old daughter.
Her usual job is to be a drinker at a local luxurious club, not to mention at night, and every time there is a lot of noise, the neighbourhood is particularly upset, so she is more or less aware of her every move.
Subsequently, the police knocked on the door of the family home.
“Please, someone’s home…”
Without waiting for the police to finish, the door in front of them opened and even brought a storm.
The door is open by Shinko himself.
She looked at the police in front of her face, with her arms around her, and her daughter hid behind her.
“What can I do for you? “The words are incontrovertible.
The attitude of the police to see each other is not of much concern, after all, as is always the case with the dialogue between them and the wine lady.
“Ma’am, there’s a child missing. Have you seen him? The police officers patiently took photos of the city’s Maru.
The suco reached out to the picture and took a closer look at it, like a memory.
“Yes, I have seen him.”
“I was going home the other day, and he came to ask me how to get to Watanabe’s house, and I pointed him out. I’m sorry.
After that, I never saw it again. I’m sorry.
The succulent arms responded, and the tight head was never released.
One word, calm and clear.
But for the police, the more so, the less logical.
In previous checks, people who hear that there are children missing around them care about “who’s kids” and “how old.”
In particular, parents with children in their homes, who heard the news, appeared to have blown up a pot and had to pull the police to find out whether the bad guys in the area were threatening their children.
But it’s not the same for her. Although she has a little girl, it’s not about her, it’s about trying to figure out what she looks like.
In addition, the word “Watanabe” in her words has raised the level of police vigilance.
Because it’s the only person besides his family who knows that Jung-maru is going to the Watanabe family.
Then, in the face of repeated police inquiries, the response was even somewhat impatient.
“I just pointed him out, and I didn’t know where to go. I’m sorry.
The police then went to Kaju son ‘ s house to conduct a Lumino test without any blood reaction.
At that time, the succulent son appeared to have endured to the limit, as soon as the front foot of the police stepped out of the house, and her back foot filmed the door.
The police officers who ate the ash had no choice but to keep an eye on the woman.
(ii) Mysterious telephone calls
Yumaru was out of his house on January 10th.
The youngest son of the family was 9 years old, and that morning he sat at the dining table and enjoyed his mother’s well-prepared breakfast, and his father and brother had eaten and watched today’s morning newspaper just in the morning.
At 9.35 a.m., an unexpected telephone call broke the family ‘ s joy.
Because his younger son was nearer to the telephone, he received the telephone in great ease.
“Hello.
“Okay. I’m sorry.
“I’m going out to get it. I’m sorry.
After three words, he did not hand over the microphone to his family, as usual, but simply hung up the phone.
Who’s the electric power?
When my mother had not finished, she rushed into the bedroom and came out with long sleeves and ran to the door.
From wearing clothes, changing shoes to going out of the house, he did not look at his family and left behind a message that he had lost his head.
“Mother Watanabe just called and said she borrowed my stuff and now she’s giving it back to me. I’m going out. I’m sorry.
Watanabe?
Who’s Watanabe?
The parents and the eldest son face each other and no one has ever heard of a Watanabe family friend.
Mom’s got seven or eight in her heart, so I’ll let the eldest son out.
Sometimes the more people panic, the more likely they are to make mistakes.
Yumaru’s brother is a close-sighted eye because he left in a hurry and forgot to wear glasses!
It happened to be snowy, and he saw Quwanmaru running 100 meters away in the snow and turned left.
As he followed, he saw a door sign in front of the apartment at Miyagi, written “Watanabe” and suddenly laid down his heart.
“It seems that my brother really went to Watanabe’s house. I’m sorry.
He didn’t want to go home alone.
But the whole family waited until night and Junmaru didn’t come back.
It’s strange that even if you’re so greedy, you should go home at night.
The parents remembered the strangeness of the morning and decided to go to the Watanabe house.
The Watanabe family opened the door to a senior girl, who was behind her, with a desk and study materials, and seemed to be focusing on preparing her examination at home.
“Please, is my Qinmaru playing at your house? “My mom is anxious to ask.
“Choumaru? Who’s Chumaru? The girl replied with a confused face.
As soon as I heard that, my mother wrinkled her head and said that she was going to Watanabe’s house.
“Juwanmaru left on your home phone and never came home since. I’m sorry.
“No way, I didn’t call today. I’m sorry.
The girl invited her to the house and opened the door.
You know, these apartments are very common in Japan, are small and simple, and can be seen in their entirety at random.
The couple were examined from one room to the next and there were no traces of outsiders, not to mention a playful child.
When I left the Watanabe family, did the parents not stop to fall?
Found it late at night and they called the police.
The first reaction was “kidnapping” when the police heard the news, after all, the urban Maru family was a famous “rich family” nearby.
(Mr. Yumaru ‘ s profession is currently described in two terms, one by the Parliamentary Secretary and the other by the president of a company with a rich family. I’m not sure.
That night, the police secretly installed a listening device at his home in order to prepare the kidnappers for the extortion call.
However, three days of quiet waiting, no telephone calls for extortion and much concern among neighbours.
On 14 January, the police turned the case of Zhongmaru’s disappearance into a public investigation, and the scene began.
The police, while staring at her, expanded their search and found her, and there was still no trace of her.
Three weeks later, the police officers who had unsuccessfully searched the case announced that the case had been put on hold, while their day and night surveillance of Kudo Ka’s son ended.
But on the second night of the police evacuation, Kudo Ka-suko suddenly moved away overnight…
And then the neighbor remembered, “Look at her rush, it’s like a temporary decision!” I’m sorry.
Since then, a 9-year-old city-maru has been a mystery.
(iii) Murderers and frauds
In May 1986, Junmaru disappeared for two years.
After two marriages, the children entered the house of marriage.
The other half she chose this time was an honest farmer, 36 years old and a beautiful bear.
With their rich history of love and love, the family of the succubus bears are strongly opposed to their being together, and they do not want to let a divorcing girl in their house, not to mention a little girl.
I wonder what ecstasy has been poured on a succulent bear, and I have no problem trying to establish a relationship with the succulent child as soon as possible, with no regard for the views of the family.
And when Kajuko made the “no farming” offer, she said yes without hesitation.
Life after marriage is just a few months old and happy.
Survivors work outside to run their farms to subsidize their families, while their sons are at home to take care of their daughters and husbands.
But not long ago, unsettled kids started to get tired of this boring life, and gambling machines became her new hobby.
One of her favorite games is Pachinko, a game where you can see the gains by shaking the handle, and she tastes the great sweets.
(Palchinko Shop, Japan)
If you win or lose, you lose, and you spend the whole day in the game hall, you lose and lose.
People who work hard to earn money, their wives gamble in casinos and can’t afford to be honest for a long time.
But I didn’t expect this honest man to have an accident before he got angry.
On December 30, 1987, at 3 a.m., the second floor of the farm house where the couple lived broke fire and rolled out of smoke.
When the firefighter completely extinguished the fire, it became clear that the man sleeping on the second floor had died, and that the woman and daughter had escaped in time for the fire because they were sleeping on the first floor.
The police were surprised to find out that the fire victim was Kudo Ka-suko, who had been under surveillance three years ago!
However, two cases were not linked at the outset by the police as a coincidence, since it had been two years since the disappearance and this was an “unplanned fire”.
In a few hours, however, the police “shocked the face.”
Because the fire was suspicious, it all pointed to Kudo Kaushuko.
According to the leads provided by witnesses the same night, after having escaped with her daughter, she was not only dressed up, but also held tight in her hand, with what seemed to be important.
Moreover, the neighbor next to the Kajuko family found something wrong.
“Our family is near to the house of her son-in-law, who did not come to my house to call the fire, but went about 300 metres to borrow a phone. I’m sorry.
Why did Shinko act like she was prepared for the fire and went to the police?
When the police were confused, the insurance company called them.
“Sergeant, we want to confirm the circumstances of the death of the bear and his family filed an application for insurance compensation today. I’m sorry.
This family, it’s the birthday boy.
Turns out that the handbag, which had been tweaked with succulent children, had a policy of up to 190 million yen, while the beneficiary had the name Kudo and succulent.
The police began to suspect, in conjunction with the strange act of Kajuko on the night of the fire, that this was a deliberate arson, murder and fraud.
After all, a normal couple would not immediately apply for compensation for insurance on the day after the other half died.
Unless, otherwise.
With these suspicions, the police began further investigations into Kudo ‘ s relationship with her husband.
In fact, she’s never been as happy after marriage.
One day, he complained about drinking under the porch of the door, “I feel like I’m going to be killed by the birthday boy. I’m sorry.
Friends laughed a few times, just when it was all a random complaint after he drank.
Now that’s the way it is, probably the friend didn’t think that Kaoko might have done the same thing.
The insurance company refused to pay compensation on the basis of the suspicion of fraud and the police investigated the fire scene carefully.
However, due to the complexity of the cause of the fire in the farm house, there is no direct evidence that the child was deliberately set on fire, and she was subsequently released from suspicion.
This sense of weakness, which was experienced by the police at the time of his disappearance, is no longer possible.
How many secrets do you have?
Until six months later, a bag of human bones emerged and solved the mystery.
(v) Body tracing
In June 1988, six months after the death of her sister-in-law, his brother-in-law came to the scene of the fire and prepared to collect the remains of the deceased.
In fact, the marriage, which he did not care about in the first place, had been set on fire by the whole family after the death of the saucy bear.
However, the police did not find any strong evidence and the family had to watch the woman leave easily.
His brother-in-law carefully packed his belongings and lamented the misfortune of a beautiful bear.
However, as he was about to leave, a plastic bag filled with material in the corner of the warehouse had drawn his attention.
The brother-in-law did not think too much and went over to Liso to open the bag, and a few seconds later he sat on the floor in shock.
A pile of burned bones appeared before him!
Looks like human bones.
The frightened brother-in-law called the police.
The human bones in the bag were subsequently identified by a forensic expert as belonging to a child of up to 10 years of age.
As a result, the police present were shocked by the fact that they were conceiving a person, Junmaru.
More than four years have passed since his disappearance, when he was only nine years old.
Yukmaru, Kudo Kauko, child bones…
When this information is intertwined, the truth that one does not want to believe has surfaced.
The local police first carried out a new round of visits to the homes around the apartment at “Sult House”.
According to some witnesses, on the night of his disappearance, he had seen Shinoko sneaking out of his apartment with several boxes.
Residents near the new house (fired farm house) after the move said to the police: “One day the housewife (senior) did not know what was burning, and the air around her house became stenchy that night, with a smell of oil fat burning. I’m sorry.
Is it true that the body of Shinmaru was taken to the new residence and then burned?
The police then formally interrogated Kudo Kajuko.
“Where did the bones come from in the warehouse? I’m sorry.
“I don’t know. I’m sorry.
“Did the boy really not enter your house? I’m sorry.
“None. I’m sorry.
During his interrogation, he had a clear and calm mouth and looked up to the police.
When an innocent ordinary person is suspected of killing, most of them are emotional and panic-ridden, trying to explain and justify.
She did not, however, and she looked almost exactly the same at the time of her first visit.
Calm down and don’t take it personally.
Soon, the police will know where the confidence of the child comes from.
Because the DNA identification technology of the 1980s was not as advanced as it is today, it is impossible to confirm that that bag of human bones belonged to the city Maru.
On the one hand are suspects who deny it and on the other hand are uncertain evidence.
In a third time, the police released Shinko Kudo and made her leave the police station laughing.
As a result, Japan’s “disappearment of the city Maru” was set aside again.
Until 10 years later, DNA technology had developed, and a battle without smoke had been officially launched.
This time, will the sly Kudo Kaushuko leave smiling?
(vi) Silence is “Gold.”
In 1998, the 14th year of his disappearance.
In the year, DNA identification technology made breakthroughs and many of the remaining puzzles were solved.
The disappearance of Zhongmaru also led to a critical breakthrough — the remains found in the warehouse that year did belong to Zhongmaru.
However, the cause of death remains unproven.
As a result, the families can no longer deceive themselves and expect their youngest son to be alive. In that cold winter, 9-year-old boys will never be able to return to their families.
On 15 November, the police officially arrested Shinko Kudo.
At her home, the police searched a blue children ‘ s table with a incense and an ambush for the blessing.
Apart from that, the police have found no other evidence of suspicion, especially as to the motive and method of the killings.
That is why, in the face of the charges of murder, Shinoko kept quiet and refused to say one more word.
She knew that only after that month could she regain her freedom.
The statute of limitations for the prosecution of the crime of destruction of the body was long overdue, as stipulated in Japanese law at the time.
The only person who could have brought a child to justice was a murder that expired in one month (then 15 years of public prosecution).
On this point, it was clear to the prosecutor who had brought charges against her, and proceedings were brought against her with the whipping.
The basis for the prosecutor was based on two main points: one was that the remains of Chumei-kun were found at Kao-suk’s house; the other was that he was the only one who knew the key message of “Watan” and finally met him.
In court, however, the right to silence was firmly used, and in response to over 400 questions from the prosecutor, the answer was “I don’t want to answer.”
Not “I don’t know” but “I don’t want to answer.”
And the hand-cuffed and slain children, and the eyes were filled with joy and provocation of victory, as if they had told everyone that I had indeed killed, but you had no choice over me.
In the media, the pride of the Shinoko in court has caused a great shock.
Everyone is convinced that, even if no clear evidence is found, Shinoko must have been the murderer.
On the one hand, the anxious prosecutor and the Yumaru family, on the other hand, Kudo Ka-sunko, who passed away one minute in a moment of silence.
It’s like a silent battle.
On 30 May 2001, the Sapporo District Court handed down its judgement in public.
“Although the evidence shows that the defendant was highly suspected of killing him, he was acquitted due to uncertainty as to the cause of death of the victim, the lack of a clear motive of the defendant and the statute of limitations for causing death/abandonment/depletion of body. I’m sorry.
On 19 March 2002, the second instance upheld the first instance judgement and the prosecution suspended the appeal.
However, the case has not yet come to an end and there is even an extremely ironic reversal.
In May 2002, in an attempt to show the people around him their innocence, Shinoko applied to the Government for criminal compensation of $11.6 million plus part of the costs of the proceedings. 928 days at a maximum of 12,500 yen per day)
Criminal compensation is the compensation that may be requested in the event that the accused is finally acquitted as a result of a criminal case.
On 18 November, the Sapporo District Court, in accordance with the provisions in force, finally decided to pay the amount of $9.28 million (at 10,000 per day) and $2.5 million for the fees of lawyers, totalling Yen1.78 million, or approximately 80 per cent of the amount claimed.
The modern version of “Silence is Gold” has been re-explained by Shinko Kudo.
Since then, the 15-year-old “Sunmaru’s disappearance” has ended with a complete “winner” for his son.
(vii) Crime analysis
Throughout the case, there are many doubts and ambiguities.
For example, what’s the motive for killing her? What is Japan’s system of prosecution?
In response to those questions, I made some speculations and analyses.
I. Undefined motives for killing
The motives of Kudo Ka suko remain unclear, but two possibilities can be inferred from their family and social background.
The first possibility: murder for money.
Suoko Kudo was born in Hokkaido and did not go back to school after he graduated from junior high school, choosing to work in a spa.
Married in Tokyo at the age of 26, but divorced a year later, having a daughter with her former husband.
In January 1984, Kajuko lived in an apartment in Sapporo Fungping District after her divorce and served as a companion at a luxury club.
At that time, her debt exceeded 7 million yen, of which 6.36 million were to be repaid in the short term.
That is to say, during the time of his disappearance, the life of his son was burdened with huge debts.
Mr. Yingmaru is the Senior Secretary of Congresswoman Abe Fu Hung, and has a rich family, living in a mansion called “the palace”.
The Porsche double-drives in the garage, the BMW and the classic car Morgan are also luxury cars that everyone envys.
Therefore, I assume that the abduction of Yuenmaru was lured by her to extort money.
And this plan may have started early.
Although he was a child, he could not have been too cautious about strangers.
It is probably because they knew each other.
You know, Kajuko has been a drink lady at a long place for entertainment and is very familiar with the technique of observancy.
As a result, she has changed her name to Watanabe, using her family and her two-year-old daughter to interact with her as she spends her time with her to gain trust.
After a great deal of familiarity, a telephone call was made to his home and a kidnapping was carried out.
As for the reason why she did not make a blackmail call, she killed him, perhaps because she heard the family looking for him and shocked the police.
She therefore preferred to give up her ransom and not risk being arrested for kidnapping.
The second possibility is to hire a murderer.
Kudo Kaushuko has been working as a companion for a long time and has served as an escort at a luxury club.
In her work, she is likely to meet some powerful guests.
His father is a high-ranking official of the Government and his personal ties are extremely complex and his family may be targeted in disputes over interests and power.
You know, there was a lot of money and debt.
At this time, if someone were willing to pay her a high commission to kill him secretly, she would probably have promised to pay her debt.
In other words, Shinko may have been hired by Mr. Junmaru ‘ s political opponents.
The ultimate aim of the son is therefore to complete the tasks ordered by the employer, not to demand a ransom.
Together with her extremely calm response in court, it is highly likely that a strong team of lawyers is behind her.
After all, how can a low-school, mixed-drink-coloured drinker girl be so secretive and profitable?
How could she be so clear and thorough about “drilling” Japanese law?
And none of the numerous information in this case was a photograph of Kudo Kaushiko.
It makes you even more conceited.
II. TIME OF PROCEEDINGS FOR CONCLUDING PROCEEDINGS
The period of prosecution, in short, the period of criminal prosecution.
In particular, under the previous Japanese-Korean law, the perpetrators of certain cases are “free” and continue to enjoy impunity as long as they pass the indictment period.
So the system of periods of public prosecution, since its inception, has given rise to numerous disputes.
In 1982, the indictment period was pushed to the forefront of public opinion because of Japan’s sudden “Sunsan Dinosaurs Kill” campaign.
The murderer, Mr. Fukuda, was charged with murder by the search authorities on 18 August 1997, 11 hours before the end of the prosecution period, and finally, in November 2003, he was sentenced to life imprisonment by the Supreme Court, on the basis of proven evidence.
In other words, if the arrest takes place later, the murderer can live a fair and free life.
However, she was “luckily” for having managed to escape legal sanctions by insisting on the limited nature of the system of prosecution and her right to remain silent.
The legitimacy of the prosecution system has again been magnified in the eyes of the public, as the “Choumaru incident” in Japan has caused a huge increase.
Since then, the system of public prosecutions in Japan has been changing.
In 2004, Law No. 156 amended article 250 of the former Code of Criminal Procedure, considerably extending the statute of limitations period and intensifying the fight against serious crimes such as homicide, injury to death and rape.
In particular, the statute of limitations is 25 years (as amended before 15 years) in cases where the perpetrator is charged with a capital offence.
In cases where the perpetrator is charged with a crime of indefinite punishment or imprisonment, the statute of limitations for prosecution is 15 years (as amended to 10 years).
The revised Code of Criminal Procedure, promulgated and implemented on 27 April 2010, abolished the statute of limitations for the “criminal offence of homicide” and changed it to an indefinite period.
The law is by no means static, but, on the contrary, as the sky and the sea have changed by wind, the law has changed by circumstances and times. — Hegel (De), Philosophy of Law filing number: YXA1Mbx8EKoud56eyxosRgRr
I don’t know.
Keep your eyes on the road.
